Guatemala: Statement by the Spokesperson on the re-appointment of the Prosecutor-General

The decision of President Giammattei to re-appoint current Prosecutor-General Consuelo Porras raises concerns about the commitment of the Guatemalan authorities to tackle corruption and safeguard the independence of the judiciary.  Under the supervision of this Prosecutor-General, the Public Ministry has initiated legal action against several independent judges, lawyers and prosecutors involved in investigating high-level cases of corruption.  This has resulted in their arrests and loss of their judicial immunity.  It forms part of a wider pattern of intimidation and harassment that has led over 20 justice operators to leave the country.

The rule of law and strong independent institutions are essential for the success, inclusivity and sustainability of Guatemala’s social and economic development. The role of the Prosecutor-General is crucial, including in leading the fight against corruption and impunity. It is essential that this function is carried out with integrity, impartiality and in full respect for the constitutional order, and avoiding actions which have the effect of damaging judicial independence.
