EU Intervention

Mister President,

The EU thanks the Fact Finding Mission for their work and final report, which gives important recommendations for further steps on the road to lasting peace and unity in Libya.

Widespread violations of human rights and international humanitarian law are still prevalent in Libya, including sexual and gender-based violence, extrajudicial killings, enforced disappearances, arbitrary detentions and torture. Civic space continues to shrink and we are deeply concerned by reports of arrests and acts of intimidation infringing on the freedom of civil society actors, in particular Libyan activists and NGOs.

The conditions in which Libyan citizens, migrants and refugees are detained in Libya remain deeply alarming. The findings of the FFM report are of serious concern. Migration management always needs to adhere to internationally recognized human rights standards and principles.  However, we take issues with certain elements of the FFM report regarding EU and MS assistance to Libyan authorities in this area. Libya is a key third country along the Central Mediterranean route and the EU is committed to its cooperation and dialogue with the Libyan authorities on strengthening migration management and respect for human rights. The EU continually assesses its own methods to improve them and we will continue constructive engagement with all relevant international actors on how we can best contribute to the common objective of ensuring protection of human rights, including in the context of migration management.

It is now essential to see how the recommendations of the FFM will be translated into action. We call on Libyan authorities to cooperate fully with the United Nations human rights system and the International Criminal Court, and to facilitate their unhindered and safe access to all parts of Libya, including places of detention.

The EU stands ready to work with Libya towards sustainable peace and stability while supporting reconciliation, transitional justice and national unity.
