Overview of the activity of vetting bodies until 14 June 2024

Decisions of the Independent Qualification Commission: 767 in total, out of which

·256 dismissals; Following decisions of the Special Appeal Chamber, 14 dismissal decisions of the IQC were modified into confirmations, 1 dismissal decision was modified into suspension from office and 3 such decisions were modified into termination due to other reasons.

·344 confirmations in duty; Following decisions of the Special Appeal Chamber, 35 of such confirmation decisions of the IQC were modified into dismissals, 1 confirmation decision was modified into suspension from office and 1 confirmation decision was overruled into termination due to resignation.

·159 decisions on termination of the vetting proceeding, out of which 110 due to resignation and 49 due to other reasons. Following decisions of the Special Appeal Chamber, 3 termination due to resignation decisions of the IQC were modified to terminations due to other reasons and 3 terminations due to other reasons were rather considered as resignation and subsequently the Special Appeal Chamber imposed the ban of appointment of the assessee as a judge or prosecutor of any level, a member of the High Judicial Council or High Prosecutorial Council, High Inspector of Justice or General Prosecutor, for a period of 15 years.

·8 decisions of suspension from office. After the School of Magistrates training, 5 suspension decisions were afterwards taken by the Independent Qualification Commission on confirmation in duty and following decision of the Special Appeal Chamber, 1 of such decisions was modified into confirmation.

 

Appeals filed by the assessees and the Public Commissioners (PCs): 381 in total, out of which:

·278 filed by assessees;

·107 filed by the PCs (4 out which were also filed by the assessees);

·128 of the above appeals are still pending.

 

Decisions of the Special Appeal Chamber (SAC): 253, out of which:

186 upholding IQC decisions (including one decision delivered after the case was re-adjudicated in the merits pursuant to article 494 Civil Procedure Code).

67 deciding total or partial modification/overruling/termination based on Article 4.6 of the vetting law of IQC decisions, among which in particular:

·on 35 occasions the SAC modified confirmation decisions of the IQC and dismissed the assessees;

·on 15 occasions the SAC modified 14 dismissal decisions of the IQC and 1 suspension decision and confirmed the assessees in duty;

·on 2 occasions the SAC modified 1 dismissal decision and 1 confirmation decision and suspended the assessees from office.

Final decisions (following exhaustion of national judicial remedies): 615, out of which

·279 confirmations;

·175 dismissals;

·161 terminations (out of which 109 due to resignations).
