SYNTHESIS OF CLARIFICATION LETTERS

Requests for clarification were sent to the General Inspectorate for Emergency Situations of the Ministry of Interior Affairs of the Republic of Moldova, after 11.04.2020.

According to point 13 of the Instruction to Tenderers, " Tenderers may submit questions in writing to the following address up to 21 days before the deadline for submission of tenders..", and in point 2 of the same Instruction, potential bidders were presented with the Calendar of activities within the procedure, by which it was established that “the last date on which clarifications are issued by the Contracting Authority is 03.04.2020”.

On 09.04.2020 on the official website of the Contracting Authority, and on 10.04.2020 and in the Official Journal of the EU, was published Corrigenda no.1 by which (due to the declaration of the state of emergency in the Republic of Moldova and the impossibility of physical submission of tenders by potential bidders), the deadline for submission of tenders was extended, specifying that "all other terms and conditions of the contract notice remain unchanged.".

Moreover, respecting the procurement procedures and giving as much time as possible to potential bidders in order to plan, organize and submit bids, the Contracting Authority published on 02.01.2020 in several sources, including on the official website of the institution and in the Official Journal of the European Union, Prior information notice.

The clarification addresses reached GIES in excess of the terms established by the tender dossier, and in accordance with the same point 13 of the Instruction to tenderers, "The Contracting Authority has no obligation to provide clarifications after this date".

However, in order to ensure as many participants as possible in the Tender and the receipt of qualitative tenders respectively, the Contracting Authority examined the clarification questions and punctually answer, below.

The question nr.1:

I request you to provide us the following details before we buy the document:

  1. List of Items, Schedule of Requirements, Scope of Work, Terms of Reference, Bill of Materials required.
  2. Soft Copy of the Tender Document through email.
  3. Names of countries that will be eligible to participate in this tender.
  4. Information about the Tendering Procedure and Guidelines
  5. Estimated Budget for this Purchase
  6. Any Extension of Bidding Deadline?
  7. Any Addendum or Pre Bid meeting Minutes?

We will submit our offer for the same if the goods or services required fall within our purview.

Also we would like to be informed of future tenders from your organization. Hence, we request you to add our name to your bidder’s list and do inform us about upcoming Projects, Tenders.

The answer nr.1:

 As specified in the Contract Notice (Section I.3 Comunication), the tender dossier can be downloaded directly, unrestricted and completely free of charge by accessing the link in this section (http://dse.md/ro/content/achizitionare-autospeciale-in-cadrul-proiectului-smurd-2).

Details of eligibility and origin are specified in point 3.1 of the Instruction to Tenderers, respectively point 8 of the Contract Notice and cannot be interpreted otherwise;

In accordance with Corrigenda No 1 published in the Official Journal of the European Union, reference number 2020 / S 072-173465 (https://ted.europa.eu/udl?uri=TED:NOTICE:173465-2020:TEXT:EN:HTML&tabId=1), the deadline for submission of bids was extended until 01.06.2020, 10:00 local time, and in accordance with Corrigenda no.2 - until 16.06.2020, 10:00 local time .

Any information about the procurement procedures organized by the General Inspectorate for Emergency Situations of the Ministry of Interior Affairs of the Republic of Moldova can be examined by accessing the official website of the institution (http://dse.md/ro/achizitii);

The question nr.2:

Reffering to the Lot. no. 2 “8 units Special vehicles for emergency medical care, first aid, extrication and rescue, type FRAP”, document “TECHNICAL SPECIFICATION - special vehicle for emergency medical care, first aid, extrication and rescue”, point #5.5.4 “Battery driven combi cutting/spreading tool”:

Regarding specs c), d), e) and i):

2.1. All the current tender requirements for forces, distance and weight, although specified as lower or upper limits, are extremely close to the respective values published in the datasheet of the tool SPS 360 MK2 E-FORCE3 manufactured by Weber. Consequently, it is impossible to offer any other similar product.

2.2. We strongly believe that, as the warrantor of both its own best interest and of the application of the European Union regulations regarding free competition, the contracting authority does not intend to block the access of all the other manufacturers, except of Weber.

2.3. Considering that the European Standard EN 13204:2016 precisely states all the safety and performance requirements for rescue tools, and that each manufacturer of such equipment must comply with this standard, we propose you to append the point 5.5.4 with the following clarification: “The combi tools that are equivalent to those defined by the tender specifications, meaning that they belong to at least the same combi tool classification “CK” and cutting capacity “H”according to EN 13204:2016, shall be considered compliant and accepted.”

Regarding spec d):

2.4. Noting that the tender does not spec the voltage source for the battery charger, we propse you to append the following clarification: “Two battery chargers must be delivered: one with the voltage source of 220-240V AC, the other of 12-24V DC”.

The answer nr.2:

2.1. The technical characteristics of any equipment, tool, machinery are determined and included in the technical specifications taking into account the needs of the Contracting Authority and especially of the final consumer - rescuer / firefighter, based on their experience and wishes. There are no fixed values in the technical specifications (a situation found by you as well), which would limit the participation with offers of several economic operators (producers), and in the case of extrication tools - they are dozens.

    1. The Contracting Authority did not announce a procurement procedure for extrication tools but for special vehicles, which are a complex unit and probably give the possibility to several producers to offer their product, possibly based on a consortium, alliance, subcontracting, etc. As specified in point.2.1, GIES has developed the specifications taking into account its own needs, providing a margin of values, and the Evaluation Committee will take into account any offer that meets the qualification criteria and technical requirements.

2.3. Standardization documents, including EN standards, are acts that must be followed by manufacturers in order to deliver compliant products. IGSU does not have these obligations through its statute and attributions, but as a beneficiary, it can request the provision of material goods corresponding to the standards. Examining your proposal to add to point 5.5.4 the expression "CK classification", we find that the product described in the specification and so fits into this classification: minimum expansion force> 35 kN (in our case - range 40-780 kN) ; minimum expansion distance> 350 mm (in our case - minimum 350 mm). According to the “CK classification” (EN13204: 2016) the cutting force can be any in the existing ranges A - K, and you suggest to include expressly the “cutting capacity H”. In conclusion: the product from the endowment of the truck (object of purchase) to which you refer, in the formula as described in the specification, can easily fit into the classification of EN13204: 2016, without adding other expressions or values ​​to the tender dossier.

2.4. The nominal voltage in the electrical networks (at the outlet) in the Republic of Moldova is identical to that in European countries. In turn, it is clear that any manufacturer that supplies electrical installations to EU countries will comply with the rules of these countries. In another train of thoughts, either a battery with a 220-240V or 12-24V charging source is acceptable to the contracting authority. Therefore, we do not consider it necessary to modify / complete the specifications;

The question nr.3

Reffering to the Lot no. 3 “Special vehicles for extrication, fire fighting, first aid and emergency medical care” the Annex no. 1 “Technical specification for the extrication equipment and its accessories”:

Regarding items #1, #2 and #3:

3.1. All the current tender requirements for forces, distances, sizes and weights, although specified as lower or upper limits, are extremely close to the respective values published in the datasheets of the tools manufactured by Weber. Consequently, except for Weber, all the other manufacturers are excluded from the tender.

3.2. We strongly believe that, as the warrantor of both its own best interest and of the application of the European Union regulations regarding free competition, the contracting authority does not intend to block the access of all the other manufacturers, except of Weber.

3.3. Considering that the European Standard EN 13204:2016 precisely states all the safety and performance requirements for rescue tools, and that each manufacturer of such equipment must comply with this standard, we propose you to append the tender specifications for each tool with the following clarification:

“Tools that are equivalent to those defined by the tender specifications, meaning that they belong to at least the same classification and cutting capacity according to EN 13204:2016 (respectively for the spreader classification “AS40”, for the cutter classification “BC” with cutting capacity “J” and for the rescue ram classification “TR100/350- 60/350”) shall be considered compliant and accepted.”

3.4. Noting that none of the tools are provided with means of charging the accumulators, we propose you to also append the tender specifications for each tool with the following clarification: “Two chargers for accumulators must be delivered: one with voltage source of 220-240V AC, the other of 12-24V DC.”

3.5. Considering the closed and extended lengths in the tender specs, only a certain telescopic rescue ram is compliant partially: Weber RZT 2-1360 E-FORCE2. However, having also in view that the pushing force must be at least 100 kN, not even the above mentioned Weber ram complies totally, because its pushing force on the second piston is only 62 kN.

Considering that no rescue ram in the market is compliant with the current tender specs, we propose to append the tender specification with the following clarification (as we have already proposed in the point 2.1.3.): “Tools that are equivalent to those defined by the tender specifications, meaning that they belong to at least the same rescue ram classification “TR100/350-60/350” according to EN 13204:2016, shall be considered compliant and accepted.”

The answer nr.3:

In addition, it can only be added that the request to refer to a certain class for each tool is irrelevant, because the range of technical characteristics indicated in the specification for each tool, fits perfectly in the suggested EN 13204: 2016 classes.

The question nr.4:

Extrication – Medical equipment:

In Annex 3, „List of medical equipment for the qualified first aid installed in the accessories’ compartment” in Carrying bag* I for emergency/first aid, there are requested 10 pcs pipes Guedel (sizes 000,00,0,1,2,3,4,5,6,7). Guedel pipe size no. 7 is not available (does not exist). We reqest the elimination of the size no. 7 Guedell pipe.

Alternatively, we can provide an extra pipe from the range 000 – 6.

The answer nr.4:

This requirement is due to a drafting error. A correction will be made to the specification in which it will be mentioned: “9 pieces of Guedel pipe (sizes 000,00,0,1,2,3,4,5,6)”.

The question nr. 5:

Extrication – Base vehicle

5.1. At the point 2.3.5 from the article 2.3 Rolling System is specified „Possibility of locking at least the rear differential”. We request that you also accept central locking differential with the possiblity simulate the locking of the rear and front wheels.

5.2. At the point 2.3.7 from the article 2.3 Rolling System is specified „Start-Stop” system to reduce the fuel consumption and emissions while idling.

Please also accept vehicles that are not equipped with „Start-Stop” function in order to allow a wider range of vehicles to be offered.

The answer nr.5:

5.1. Locking the center differential does not save the car from the danger of "diagonally hanging" when one of the wheels on each axle loses traction. However, in order to allow the participation of several bidders, a correction will be made in the specification in which it will be indicated "the possibility of blocking at least one differential".

5.2. In order to allow the participation of several bidders, a rectification will be made to the specification, in which the “Start-stop system” requirement, will be excluded.

The question nr. 6:

FRAP:

At the point 5.6.20.4 from the technical requirements is mentioned the Defibrillator with monitoring functions – 1 bucata, with the following characteristic: q) Fluid warmer device;

Having in mind that on the market there are no defibrillators with fluid warmer device, how is specified at the point 5.6.20.4 from the technical specifications, please specify if this requirement is due to a drafting error.

We request the elimination of this requirement.

The answer nr. 6:

This requirement is due to a drafting error. An rectification will be made to the specification, in which the requirement q) Fluid warmer device from point 5.6.20.4 will be excluded, and will be included as a separate device: Fluid warmer device.

The question nr. 7:

Type C Ambulance:

7.1. At the point 3.14.2 of the article 3.14 PAINTING AND LETTERING, is specified that „The ambulance will be marked all-around with orange coloured reflective / fluorescent tapes.”

The orange color will not be visible if the base color of the vehicle will be red. Please clarify if is acceptable all-around reflective tapes with the colour white/yellow.

7.2. At the point 5.7.9, from the article 5.7 Automatic ventilator with incorporated PEEP valve - 1 pc.”, is specified „Humidifier with warming (37°C) and temperature sensors of the delivered gas.”

The humidifiers are intended for the use of a long period of time in ventilation of the patient.

Having in mind that in the emergency system the patient is transported with the ambulance to the hospital within a short period of time.

Alternatively, please mention if you also accept ventilators that do not have heated humidifiers.

The answer nr. 7:

7.1. Is due to a drafting error when the orange color was indicated. The white / yellow color of the reflective tapes is accepted, and in this sense a correction to the technical specification will be made.

7.2. Ventilators that do not have heated humidifiers is accepted. A correction shall be made to the specification excluding the requirement of paragraph 5.7.9.

The question nr. 8:

FRAP

At the point 5.4.3 from the technical requirements of the installation for firefighting intervention is mentioned that the pump unit must ensure the discharge of water at a pressure of minimum 150 bars and the discharge will be achieved through a D type hose with a length of minimum 50 meters. Given that at a pressure of 150 bar the flow of discharged water is about 40 liters per minute and the type D hose is too large for this flow and this type of motor pump, usually used for pressures up to at 60 bar, please accept delivery of a type of hose used and recommended by all manufacturers of these systems, the quick couplings with 50mt tube Ø3/8" SC.

The answer nr. 8:

Accepted. A rectification will be made to the specification, in wich will be excluding the expression "D type hose" from the description in point 5.4.3.

The question nr. 9:

Extrication

9.1. Regarding to those mentioned in articles 2.1.5 and 2.1.6, where reference is made to the engine minimum power should be 140 kW and engine displacement that should be between 2500 – 3000 cmc, please also accept vehicles that have engines with displacement of minimum 1950 cmc and power of minimum 130 kW, who can fulfill all other technical requirements.

9.2. Regarding to those mentioned in article 2.3.16, where reference is made to the approach angle that should be minimum 30 degrees, please also accept vehicles with approach angle of minimum 20 degrees, order to allow multiple participants at this tender.

9.3. Regarding to those mentioned in article 2.1.9, where reference is made to the fuel tank capacity of minimum 90 liters, please also accept vehicles that have the tank capacity of minimum 75 liters and can achieve the autonomy requested of 800 km.

The answer nr. 9:

9.1. Taking into account the dimensions and maximum mass of the vehicle, the quantity of equipment and machinery required to be mounted on it, and wishing to obtain an operational intervention truck, it is not acceptable to reduce the required engine characteristics. However, on the basis of the clarification letters, the Contracting Authority will make a correction to the technical specification by modifying certain performance characteristics and dimensions of the base vehicle. Please follow the corrections that will be made to the tender dossier.

9.2. On the basis of the clarification letters, the Contracting Authority will make a correction to the technical specification by modifying certain performance characteristics and dimensions of the base vehicle. Please follow the corrections that will be made to the tender dossier.

9.3. It is important that at a set value of the rated engine power and fuel control consumption , the size of the tank can providing an autonomy of minimum 800 km. For this reason in the technical specification there is the expression "… 90 liters and / or to providing an autonomy of minimum 800 km". So, a size of 75 liters of fuel tank is accepted, strictly respecting the other performance values.

The question nr. 10:

FRAP

10.1. Regarding to those mentioned in article 5.1.9, where reference is made to the fuel tank capacity of minimum 90 liters, please also accept vehicles that have the tank capacity of minimum 75 liters and can achieve the autonomy requested of 800 km.

10.2. Regarding to those mentioned in articles 5.2.5.1, 5.2.5.2 and 5.2.5.3, where reference is made to the engine maximum torque that should be minimum 440 Nm, engine power that should be minimum 140 kW and engine displacement that should be between 2500 – 3000 cmc, please also accept vehicles that have engines with maximum torque of minimum 410 Nm, with displacement of minimum 1950 cmc and power of minimum 130 kW, who can fulfill all other technical requirements.

10.3. Regarding to those mentioned in article 5.2.1.2, where reference is made to the vehicle width that should be of maximum 2000 mm without mirrors, please also accept vehicles with width of maximum 2070 mm without mirrors. This characteristic will allow a more ergonomic arrangement in the back compartments and also will allow multiple participants at this tender.

The answer nr.  10:

10.1. The answer is similar to that in point 9.3 (see above).

10.2. The answer is similar to that in point 9.1 (see above).

10.3. On the basis of the clarification letters, the Contracting Authority will make a correction to the technical specification by modifying certain performance characteristics and dimensions of the base vehicle. Please follow the corrections that will be made to the tender dossier.

The question nr. 11:

Extrication and FRAP:

    1. According to the technical specifications of the extraction vehicle and of FRAP, mentioned in article 2.1.5, respectively article 5.2.5.2, where reference is made to the engine power of at least 140 kW, please also accept vehicles with a minimum power of 130 kW, in order to allow multiple participants at this tender.

Extrication

11.2. Regarding to those mentioned in article 1.2.14, where reference is made to the wheelbase of the vehicle which should be minimum 4200 mm, please also accept vehicles with a wheelbase of at least 4150 mm, in order to allow multiple participants at this tender.

FRAP

11.3. Regarding to those mentioned in article 5.1.5, where reference is made to the gross maximum weight of the vehicle which should be maximum 5000 kg, please also accept vehicle with a gross maximum weight of maximum 5500 kg, in order to allow multiple participants at this tender.

The answer nr. 11:

11.1. The answer is similar to that in point 9.1 (see above).

11.2. On the basis of the clarification letters, the Contracting Authority will make a correction to the technical specification by modifying certain performance characteristics and dimensions of the base vehicle. Please follow the corrections that will be made to the tender dossier.
