In cooperation with the Supreme Court of the Republic of Kazakhstan, the EU-Central Asia Rule of Law Platform conducted an expert analysis of a pilot court of justice of Kazakhstan. An audit mission of the District Court of Tselynograd (as pilot court of general jurisdiction) took place in Akmola region during September-October 2016. It was conducted by a team composed of Mr Hervé Expert, former President of the Appellate Court of Fort-de-France, and Mrs Elena Akmoldaeva, former judge at the Supreme Court of the Republic of Kazakhstan. The mission was comprised of exchanges and interviews of court staff, the local general prosecutor’ office, bar association, bailiffs and other representatives of relevant professions, an analysis of applicable legislation, regulation and case-law, and on site visits. With focus on judicial governance, organisation and procedures, the mission identified existing good practices, possible weaknesses, shortcomings and failures, evaluated the adequacy of resources available, highlighting the impact thereof on the results and the image of the court, and presented its report to the Supreme Court of Kazakhstan. The audit report includes recommendations based on the in-depth analysis of the pilot court.
On 26 January 2017, in the framework of the annual plenary meeting of the Supreme Court reviewing the judicial year 2016, the Platform team of expert will present its conclusions and recommendations based on best judicial standards and practices, for generalization to the judicial system of Kazakhstan. The meeting will be attended by the judges of the Supreme Court and the Presidents of Appellate Courts of Kazakhstan, and the heads of the diplomatic missions of the European Union, France and Germany.
Resulting from this mission, the Central Office of the Supreme Court of Kazakhstan will be in a position to take action for improving judicial governance and the functioning of Kazakhstani courts. Ultimately, a quality and efficient judicial system will contribute to increasing legal safety in Kazakhstan. For EU High Representative/Vice-President Frederica Mogherini, “a deep and comprehensive judicial reform […] addresses a longstanding request by the overwhelming majority of the citizens for justice that is accountable, independent and transparent".
The EU-Central Asia Rule of Law Platform project acts as a support mechanism to facilitate policy dialogue and promote the measures contributing to legal reforms in each of the Central Asian countries. The Platform is being funded by the European Union to the amount of EUR 1.8 million and is implemented by IBF International Consulting.
