The purpose of the project is to ensure a proper implementation and enforcement of maritime liability procedures foreseen in the international conventions on maritime safety, security and the prevention of the marine pollution in the related EU Acquis.
With the aim to fulfill the objectives of the project within the scope of three main Components deep revision and detailed analysis of the Merchant Shipping Code and identification of list of violations have been carried out. Proposal of a new article to include in the Merchant Shipping Code was prepared to refer all the violations listed to the Administrative Violations Code as well as text of proposed amendments to the Administrative Violations Code was drafted. As a result on16th of May 2017 law of the Parliament No 669-VQD “on the Adoption of changes to the Administrative Violations Code” has entered into force.
Moreover after all relevant documents to ratify the Protocol of 1996 to amend the Convention on Limitation of Liability for Maritime Claims (LLMC) of 1976 have been prepared in frame of the Twinning project and submitted to the relevant authorities in accordance with the Constitutional Law of the Republic of Azerbaijan “on Normative Legal Acts” the abovementioned Protocol was adopted by the Parliament of the Republic of Azerbaijan.
In frame of the project several seminars, trainings and study tours have been arranged with the aim to study Spanish best practices in maritime field.
With the target to help to strengthen the State Maritime Administration after IMO Member State Audit carried out in the Republic of Azerbaijan with the purpose of evaluating the implementation of the requirements of the international conventions in maritime field, the project implementation has been extended for one month and one additional Component has been added.
