Individual expert assignment will be from 10 to 30 days. Civil servants and other staff currently employed by public administrations of the beneficiary country are not eligible to apply as experts. Experts must be independent and free from conflicts of interest in the responsibilities defined by the Terms of Reference.

Project Title:          Legal Harmonization and Capacity Building for Market Surveillance

Project Start Date:            12th February 2018

Project Activities:

Component 1: Harmonization of the Law of product safety and its related rulebooks with the relevant EU legislation.

Activity 1.1. Analyse the national Law on product safety and its rulebooks in view of development of EU acquis for general product safety.

Activity 1.2. Develop working methodology for legislative drafting based on EU Member States’ best practice and train beneficiary

Activity 1.3. Draft a new Law on product safety

Activity 1.4. Draft bylaws that transpose the EU acquis-the following directives will be subject of transposition:

  • Directive 2014/34/EU on the harmonisation of the laws of the Member States relating to equipment and protective systems intended for use in potentially explosive atmospheres (ATEX),

  • Directive 2014/29/EU on the harmonisation of the laws of the Member States relating to the making available on the market of simple pressure vessels,

  • Directive 2010/35/EU on transportable pressure equipment;

  • Directive 2014/30/EU relating to electromagnetic compatibility (EMC);

  • Directive 2014/35/EU relating to the making available on the market of electrical equipment designed for use within certain voltage limits (LVD);

  • Directive 2014/33/EU relating to lifts and safety components for lifts;

  • Directive 2014/68/ relating to the making available on the market of pressure equipment;

  • Directive 2009/142/EC relating to appliances burning gaseous fuels (GAD);

  • Directive 2013/53/EU on recreational craft and personal water craft;

  • Directive 2014/53/EU relating to the making available on the market of radio equipment;

  • Directive 2014/28/EU relating to the making available on the market and supervision of explosives for civil uses.

 

Component 2: Strengthening the capacities of public and private bodies in the area of free movement of goods.

Activity 2.1. Conduct a training needs assessment for capacity building of MoE, State Market Inspectorate and Technical Inspectorate.

Activity 2.3. Conduct a training needs assessment for capacity building and provide trainings in subjects related to free movement of goods

Assignment objective(s)

We are looking for experts for:

Activity 1.3 Draft a new Law on product safety. The expert is  to  contribute to:

  1. Task 1.3.1. Drafting the new Law on the product safety;

  2. Task 1.3.2.Contribute to the Public hearings on the Law on the product safety

    Activity 1.4. Draft bylaws that transpose the EU acquis ( EU acquis to be transposed is referenced above)

  3. Task 1.4.1. Training on transposition

  4. Task 1.4.2. Preparation and Analytical stage

  5. Task 1.4.3. Transposition of eu Directives into Sub-laws

    Activity 2.1. Conduct a training needs assessment for capacity building of MoE, State Market Inspectorate and Technical Inspectorate. The expert is to contribute to:

  6. Task 2.1.1. Identify problem and needs and determine the design of the TNA

  7. Task 2.1.2. Collect and analyse data

  8. Task 2.1.3. Develop training plan and training materials

  9. Task 2.1.4. Conduct training sessions

    Activity 2.3. Conduct a training needs assessment for capacity building and provide trainings in subjects related to free movement of goods. The expert is to contribute to:

  10. Task 2.3.1. Identify problem and needs and determine the design of the TNA

  11. Task 2.3.2. Collect and analyse data

  12. Task 2.3.3. Develop training plan and training materials

  13. Task 2.3.4. Conduct training sessions

    Required Expert profile

    Qualifications and Skills

    A university degree in fields related to assignment   or at least five (5) years of general professional experience above the minimum experience required in the field in case the expert does not have a university degree

    General professional experience

    Minimum 10 years of experience in the area of free movement of goods as expert in one of these domains: policy development, or market surveillance, or legal drafting, or working in conformity assessment body or similar.

    Specific professional experience:

    The expert must have a specific experience in the field of the specific assignment of at least 5 years.  Indicative list of areas of assignment is the following:

  • Implementing legislation in at least one area under Activity 1.4;

  • Conformity assessment in at least one area under Activity 1.4; or

  • Standardisation in at least one area under Activity 1.4; or

  • CE marking, or

  • Training needs assessments and development of trainingplans; or

  • Drafting of laws /by-laws in the country,

  • Organization and implementation of communication and visibility plans following EUvisibility rules, etc.
