A state - party to the proceedings of ECHR must create “all the necessary conditions” for the Court to be able to investigate the circumstances of the case, if necessary, in accordance with Article 38 of the European Convention. In particular, the state is obliged to provide the Court with the documents necessary for a full and comprehensive examination of the complaint. The existence and scope of such an obligation may be controversial if the documents contain national security information.
During the webinar, which will be held on June 30, from 12:00 to 13:30, participants will learn about the peculiarities of the application of Article 38 of the Convention during the proceedings on individual and interstate complaints and will get acquainted with relevant practice of the ECHR.
